Policies—Compliance Requirements

Due within 5 days after the Policy Effective Date.

Cancellation—Compliance Requirements

Due 10 days prior to the Cancellation Effective Date.

Illinois is a continuous coverage state; nonrenewals are required 10 days prior to cancellation date.

Reinstatements— Compliance Requirements

Due within 5 days after the Reinstatement Effective Date.

Fines—Compliance Requirements

The State Workers Compensation Act allows the state to assess a civil penalty of up to $500 per day for lack of coverage. The fine is determined on a case by case basis and is based on a number of factors, with a statutory minimum fine of $10,000.

Note: An employer may now face criminal charges and/or a work-stop order for failing to provide workers compensation insurance.

Appeals—Compliance Requirements

Appeals must be filed in the circuit courts within 20 days from the date the decision is received by the parties.
